Education Department clarifies stance on Title IX protections

The Education Department announced that it will enforce Title IX’s prohibition on discrimination on the basis of sex to include gender identity and sexual orientation. The decision cited a Supreme Court ruling last year (in Bostock v. Clayton County), which found that “it is impossible to discriminate against a person based on their sexual orientation or gender identity without discriminating against that person based on sex.”
